Triunfel.ai Terms of Service
Effective date: October 20, 2026 Last updated: October 20, 2026
These Terms of Service (the "Terms") are a legal agreement between you and Triunfel LLC, a New York limited liability company ("Triunfel," "we," "us," or "our"). They govern your use of the Triunfel.ai website at https://triunfel.ai, the Triunfel.ai iOS app (the "App"), and related services (together, the "Service").
Please read these Terms carefully. By creating an account, or by accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
IMPORTANT NOTICE: Section 17 contains a binding arbitration agreement and a class action waiver. It requires most disputes to be resolved through individual arbitration rather than in court, unless you opt out within 30 days.
1. What Triunfel.ai Is (and Is Not)
1.1 A parts reference tool. Triunfel.ai helps field service technicians and other equipment professionals look up medical equipment parts. You can upload a photo of a part or type a model number or description, and the Service suggests a likely part number and a reference to the relevant service manual or documentation (a "Result").
1.2 Not a medical device. No medical advice. The Service is not a medical device and is not intended to diagnose, treat, cure, mitigate, prevent, or monitor any disease or condition. It provides no medical, clinical, or patient-care advice. It does not determine whether equipment is safe or fit for clinical use.
1.3 Results may be wrong. Results are generated in part by artificial intelligence (AI) and automated systems, which can make mistakes. A Result may be inaccurate, incomplete, out of date, or meant for a different model, revision, or serial-number range. You must independently verify every Result against the original equipment manufacturer's (OEM's) current documentation, part catalogs, and service procedures before ordering any part, performing any repair, or returning any equipment to service. You are solely responsible for your repair, maintenance, ordering, and return-to-service decisions.
1.4 Not a substitute for training or regulatory compliance. The Service does not replace your professional training, qualifications, your employer's procedures, the OEM's instructions, or any legal or regulatory requirements that apply to servicing medical equipment (for example, FDA requirements, accreditation standards, or facility policies). You are responsible for following them.
1.5 No affiliation with manufacturers. Triunfel is not affiliated with, endorsed by, sponsored by, or authorized by any equipment manufacturer, distributor, or parts supplier. Manufacturer names, brand names, model names, and part numbers appear only to identify products and compatibility. All trademarks belong to their respective owners. Service manuals and other third-party documents remain the property of their owners. We may provide references, citations, or links to them, but we do not guarantee their availability, accuracy, or that you are licensed to use them.
2. Eligibility
To use the Service, you must:
- be at least 18 years old and able to form a binding contract;
- not be barred from using the Service under U.S. law or any other applicable law;
- not be located in a country subject to a U.S. government embargo, and not be on any U.S. government list of prohibited or restricted parties.
The Service is not intended for children. Children under 13 may not use the Service under any circumstances, and we do not knowingly collect information from anyone under 16.
Using the Service for an organization. If you use the Service on behalf of an employer or other organization, you represent that you have authority to bind that organization to these Terms. In that case, "you" includes both you and that organization. A separate written agreement with that organization, if we sign one, controls where it conflicts with these Terms.
3. Your Account
- Accurate information. You must give accurate and complete registration information and keep it up to date.
- Security. You are responsible for keeping your password confidential and for all activity under your account. Tell us right away at support@triunfel.ai if you suspect unauthorized use.
- Your login. Do not share your login credentials. Each person who uses the Service should have their own account.
- Deleting your account. You can ask us to delete your account by emailing support@triunfel.ai from the email address on the account. Our Privacy Policy explains what happens to your data when you do.
4. No Patient Information (PHI)
The Service is not designed to receive, store, or process protected health information ("PHI") as defined by HIPAA, or any other information about patients. You agree not to upload, submit, or transmit:
- photos that show patients or any part of a patient's body;
- photos of screens, labels, wristbands, records, or documents that show patient names, dates of birth, medical record numbers, or any other patient identifiers; or
- text that includes patient names or other identifiable patient details.
Before uploading a photo, frame or crop it so it shows only the equipment or part. Triunfel is not a HIPAA covered entity and does not act as a business associate. We do not enter into business associate agreements. You are solely responsible for any patient information you submit in violation of this Section, and we may delete such content without notice.
5. Acceptable Use
You agree not to:
- use the Service in violation of any law or regulation, or to infringe anyone's rights;
- upload content that you do not have the right to upload, or that is unlawful, harmful, harassing, defamatory, obscene, or invasive of another person's privacy;
- upload malware or any code meant to harm or interfere with the Service;
- probe, scan, or test the vulnerability of the Service, or bypass any security, authentication, rate limit, or usage limit;
- scrape, crawl, data-mine, or bulk-extract Results, part data, or manual references by automated means, except through an API or method we expressly allow;
- copy, resell, sublicense, or redistribute the Service or Results as a competing parts database or service;
- reverse engineer, decompile, or try to extract the source code, models, prompts, or underlying data of the Service, except where the law expressly allows it despite this restriction;
- use the Service or Results to build or train a competing product or AI model;
- impersonate any person or misrepresent your affiliation with anyone;
- use the Service to make clinical or patient-care decisions, or to represent that Results are OEM-approved;
- interfere with or disrupt the Service, its servers, or other users; or
- help or encourage anyone else to do any of the above.
We may investigate violations and take any action we think is appropriate, including removing content, limiting access, suspending or terminating accounts, and reporting to law enforcement.
6. Your Content
6.1 What "Your Content" means. "Your Content" means the photos, text queries, feedback, and other material you submit to the Service. As between you and Triunfel, Results are provided to you for your use under these Terms (see Section 7).
6.2 You keep ownership. You keep all ownership rights you have in Your Content.
6.3 License you give us (limited to running the Service). You grant Triunfel a non-exclusive, worldwide, royalty-free license to host, store, copy, transmit, process, analyze, and display Your Content only as needed to operate, provide, secure, maintain, and support the Service for you, and to comply with law. This includes sharing Your Content with our service providers (such as our hosting and AI model providers) for those purposes, as described in our Privacy Policy. We may also create and use aggregated or de-identified data that does not identify you or include your photos, in order to measure and improve the Service. This license ends when Your Content is deleted from our systems as described in our Privacy Policy, except for copies we must keep for legal reasons or that remain temporarily in backups.
6.4 Your promises. You represent that you have all rights needed to submit Your Content and to grant the license above, and that Your Content does not violate these Terms (including Section 4), any law, or anyone's rights (including privacy, confidentiality, and intellectual property rights). Do not upload confidential information belonging to your employer or customers unless you are authorized to do so.
6.5 Feedback. If you send us suggestions or feedback, we may use them without restriction or payment to you.
7. Our Intellectual Property and Your License to Use the Service
The Service, including its software, design, text, graphics, databases, and the Triunfel and Triunfel.ai names and logos, is owned by Triunfel or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service, and to use Results, for your own internal business or professional purposes. We reserve all rights not expressly granted.
8. Third-Party Services and Content
The Service relies on and may link to third-party services and content, including AI model providers, hosting providers, payment processors, app stores, manufacturer websites, and parts suppliers. We do not control them and are not responsible for their content, availability, accuracy, or practices. Your use of third-party services may be subject to their own terms.
9. Subscriptions, Billing, and Payments
Paid plans, when offered, are governed by this Section. The Service may also be offered without charge. We will show the price, billing period, and what is included before you pay.
9.1 Plans and pricing. We may offer free and paid plans (for example, monthly or annual subscriptions, or usage-based packs). We will show the price, billing frequency, and what is included before you buy. Prices exclude applicable taxes unless stated otherwise.
9.2 Automatic renewal. Paid subscriptions renew automatically at the end of each billing period (for example, monthly or annually) at the then-current price, and your payment method will be charged, until you cancel. We will clearly disclose the renewal terms before you subscribe and send any reminder notices required by law (including New York's automatic renewal law). If we change the price of your subscription, we will notify you in advance, and the change will take effect at your next renewal. If you do not agree to the change, you may cancel before it takes effect.
9.3 Free trials. If we offer a free trial, we will tell you the length and the price before you start. The subscription begins automatically, and you will be charged when the trial ends unless you cancel before then.
9.4 Purchases on the website (Stripe). Payments made on our website are processed by our payment processor, Stripe, under its own terms and privacy policy. Triunfel does not store your full card number. You authorize us (through Stripe) to charge your payment method for all fees you incur. If a payment fails, we may suspend paid features until payment is made.
9.5 Purchases in the iOS App (Apple In-App Purchase). If you buy a subscription or other digital item through the App, the purchase is processed by Apple through your Apple ID and is governed by Apple's Media Services Terms and Conditions. For those purchases:
- payment is charged to your Apple ID account when you confirm the purchase;
- subscriptions renew automatically unless you turn off auto-renew at least 24 hours before the end of the current period;
- you can manage and cancel subscriptions in your Apple ID account settings (Settings, then your name, then Subscriptions);
- Apple, not Triunfel, handles all billing, cancellations, and refunds for App Store purchases. Request refunds from Apple at https://reportaproblem.apple.com.
Deleting the App or your Triunfel account does not cancel an App Store subscription.
9.6 Cancellation (website purchases). You may cancel a subscription bought on our website at any time from the billing page in your account, or by emailing support@triunfel.ai. Cancellation takes effect at the end of your current billing period. You keep access to paid features until then.
9.7 Refunds (website purchases). Except where required by law or stated otherwise at the time of purchase, fees are non-refundable, and we do not provide refunds or credits for partial billing periods or unused features. This does not limit any rights you have under applicable consumer protection laws.
9.8 Taxes. You are responsible for any sales, use, or similar taxes associated with your purchase, except taxes based on our income.
10. Changes to the Service
We may add, change, suspend, or discontinue any part of the Service at any time, including features, usage limits, and supported equipment. If we discontinue a paid feature you have prepaid for, we will provide a prorated refund for the unused period, unless the law requires otherwise or the purchase was made through Apple (in which case Apple's refund policies apply).
11. Disclaimers
PLEASE READ THIS SECTION CAREFULLY.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL RESULTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TRIUNFEL DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE ABOVE, TRIUNFEL DOES NOT WARRANT THAT: (A) ANY RESULT, PART NUMBER, COMPATIBILITY INFORMATION, OR MANUAL REFERENCE IS ACCURATE, COMPLETE, CURRENT, OR APPROPRIATE FOR YOUR EQUIPMENT; (B) ANY PART IDENTIFIED WILL FIT, FUNCTION, OR BE SAFE; (C) THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; OR (D) ANY ERRORS WILL BE CORRECTED.
YOU ACKNOWLEDGE THAT RESULTS ARE GENERATED IN PART BY AI, MAY BE WRONG, AND MUST BE VERIFIED AGAINST THE MANUFACTURER'S DOCUMENTATION BEFORE YOU ORDER PARTS, PERFORM ANY REPAIR, OR RETURN ANY EQUIPMENT TO SERVICE. YOU USE THE SERVICE AND RESULTS AT YOUR OWN RISK. TRIUNFEL IS NOT RESPONSIBLE FOR THE SAFETY, PERFORMANCE, OR REGULATORY COMPLIANCE OF ANY EQUIPMENT YOU SERVICE.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
(a) No indirect damages. IN NO EVENT WILL TRIUNFEL OR ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, OR SERVICE PROVIDERS (THE "TRIUNFEL PARTIES") BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, OR DATA; COST OF SUBSTITUTE GOODS OR SERVICES; COST OF INCORRECTLY ORDERED, RETURNED, OR RESTOCKED PARTS; EQUIPMENT DAMAGE OR DOWNTIME; OR LABOR COSTS, ARISING OUT OF OR RELATING TO THE SERVICE, ANY RESULT, OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF A TRIUNFEL PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
(b) Cap. THE TRIUNFEL PARTIES' TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE, ANY RESULT, OR THESE TERMS WILL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID TRIUNFEL FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (ii) ONE HUNDRED U.S. DOLLARS (US $100).
(c) Basis of the bargain. These limitations are an essential part of the agreement between you and Triunfel. They apply even if a limited remedy fails of its essential purpose.
(d) Exceptions. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, such as liability for gross negligence, willful misconduct, fraud, or (where applicable) death or personal injury caused by negligence. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Triunfel Parties from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use or misuse of the Service or any Result, including any repair, maintenance, part order, or return-to-service decision; (b) Your Content, including any patient information or third-party confidential information you upload; (c) your violation of these Terms; or (d) your violation of any law or anyone else's rights. We may take over the exclusive defense of any matter subject to indemnification, and you agree to cooperate with us. You may not settle any such matter without our prior written consent.
14. Suspension and Termination
By you. You may stop using the Service and delete your account at any time (see Section 3).
By us. We may suspend or terminate your access to all or part of the Service at any time, with or without notice, if: we reasonably believe you violated these Terms (including Sections 4 and 5); it is necessary to protect the Service, other users, or third parties; it is required by law; or we discontinue the Service. If we terminate your account without cause, we will refund any prepaid fees for the unused period of a website subscription.
Effect of termination. When your account ends, your right to use the Service stops immediately, and we will handle your data as described in our Privacy Policy. Sections 1.2–1.5, 4, 6.4–6.5, 7 (ownership), 8, and 11 through 21, and any accrued payment obligations, survive termination.
15. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms and change the "Last updated" date. If a change is material, we will give you reasonable advance notice (for example, by email or an in-app notice) before it takes effect, generally at least 15 days. Changes will not apply to disputes that arose before the change takes effect. If you continue to use the Service after the changes take effect, you accept the updated Terms. If you do not agree, you must stop using the Service and may delete your account.
16. Governing Law and Venue
These Terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of the State of New York and applicable U.S. federal law, without regard to conflict-of-law rules. The Federal Arbitration Act governs Section 17. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Except for disputes resolved by arbitration under Section 17, any lawsuit must be brought only in the state or federal courts located in New York County or Bronx County, New York, and you and Triunfel consent to the personal jurisdiction of those courts. Either party may bring an individual claim in small claims court if it qualifies.
17. Dispute Resolution: Arbitration and Class Action Waiver
17.1 Informal resolution first. Before starting arbitration or a court case, you and Triunfel agree to try to resolve any dispute informally for at least 60 days. To begin, send a written notice describing the dispute and the relief requested to support@triunfel.ai (for disputes with Triunfel) or to the email on your account (for disputes with you).
17.2 Agreement to arbitrate. If the dispute is not resolved informally, you and Triunfel agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service by binding individual arbitration, except as provided in Section 17.5. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or Commercial Arbitration Rules, if you use the Service for an organization), before a single arbitrator. The arbitrator, not a court, will decide questions of arbitrability, except that a court will decide questions about Section 17.4 (class action waiver). Unless the parties agree otherwise, the arbitration will take place by video or phone, or in New York County, New York. Payment of filing and arbitrator fees will follow the applicable rules. The arbitrator may award the same individual relief a court could award, but only to you individually.
17.3 Mass filings. If 25 or more similar demands for arbitration are filed against Triunfel by or with the help of the same or coordinated counsel, the demands may be administered in batches under the applicable AAA mass arbitration procedures.
17.4 Class action and jury trial waiver. YOU AND TRIUNFEL MAY BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not combine more than one person's claims. YOU AND TRIUNFEL WAIVE ANY RIGHT TO A JURY TRIAL. If this Section 17.4 is found unenforceable for a particular claim or request for relief, that claim or request (and only that one) will be severed and decided in court after the arbitration of the other claims is finished.
17.5 Exceptions. Either party may (a) bring an individual claim in small claims court, and (b) seek injunctive or other equitable relief in court to protect intellectual property rights or to stop unauthorized use or abuse of the Service.
17.6 30-day right to opt out. You may opt out of this arbitration agreement by emailing support@triunfel.ai within 30 days after you first accept these Terms, with the subject "Arbitration Opt-Out" and your name and account email. If you opt out, Section 16 governs disputes, and the rest of these Terms still apply.
17.7 Time limit. To the extent permitted by law, any claim must be brought within one year after it arises, or it is permanently barred.
18. Apple App Store Terms (iOS App)
This Section applies if you downloaded the App from the Apple App Store. If it conflicts with any other part of these Terms, this Section controls for your use of the App.
18.1 Acknowledgement. These Terms are between you and Triunfel only, not Apple Inc. ("Apple"). Triunfel, not Apple, is solely responsible for the App and its content. These Terms do not provide for usage rules for the App that conflict with the Apple Media Services Terms and Conditions as of the effective date (the "Usage Rules").
18.2 Scope of license. Your license to use the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules. The App may also be accessed and used by other accounts associated with you through Family Sharing or volume purchasing, where the Usage Rules allow.
18.3 Maintenance and support. Triunfel is solely responsible for providing any maintenance and support services for the App, as described in these Terms or as required by law. You and Triunfel acknowledge that Apple has no obligation whatsoever to provide any maintenance and support services for the App.
18.4 Warranty. Triunfel is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App to you. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses due to any failure to conform to any warranty are Triunfel's sole responsibility, to the extent not disclaimed under these Terms.
18.5 Product claims. Triunfel, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of it, including: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation. These Terms do not limit Triunfel's liability to you beyond what is permitted by applicable law.
18.6 Intellectual property rights. If a third party claims that the App, or your possession and use of the App, infringes that third party's intellectual property rights, Triunfel, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim, to the extent required by these Terms.
18.7 Legal compliance. You represent and warrant that (a) you are not located in a country that is subject to a U.S. government embargo or that has been designated by the U.S. government as a "terrorist supporting" country; and (b) you are not listed on any U.S. government list of prohibited or restricted parties.
18.8 Developer name and address. Please direct any questions, complaints, or claims about the App to Triunfel LLC, Bronx, New York, at support@triunfel.ai.
18.9 Third-party terms. You must comply with any applicable third-party terms of agreement when using the App (for example, your wireless data service agreement).
18.10 Third-party beneficiary. You and Triunfel acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that, once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
19. Copyright Complaints (DMCA)
If you believe content on the Service infringes your copyright, send a notice to our designated agent with: your signature; identification of the copyrighted work; identification of the infringing material and its location; your contact information; a statement of good-faith belief that the use is not authorized; and a statement, under penalty of perjury, that the information is accurate and that you are authorized to act for the owner.
Designated agent: Triunfel LLC, Attn: Copyright Agent, Bronx, New York; support@triunfel.ai. We may terminate the accounts of repeat infringers.
20. Export Controls
You may not use, export, or re-export the Service except as authorized by U.S. law and the laws of the place where you obtained it.
21. General Terms
- Entire agreement. These Terms, the Privacy Policy, and any terms presented at purchase make up the entire agreement between you and Triunfel about the Service and replace any earlier agreements on that subject.
- Severability. If any provision is found unenforceable, it will be enforced to the maximum extent possible, and the other provisions will remain in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, reorganization, or sale of assets, or to an affiliate.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including outages of third-party hosting or AI providers, internet failures, natural disasters, or government action.
- Notices. We may send you notices by email to your account address or through the Service. You may send notices to support@triunfel.ai or to our mailing address.
- Electronic communications. You agree to receive communications from us electronically, and you agree that electronic agreements and notices satisfy any requirement that they be in writing.
- Headings. Headings are for convenience only. "Including" means "including without limitation."
- No third-party beneficiaries, except as stated in Section 18.10.
